1. Compliance with laws
COMOFASHION.COM.HK  is incorporated under the laws of Hong Kong. We operate in Hong Kong and comply with all the laws and regulations of Hong Kong. All our products are in compliance with all the requirements and specifications under the laws of Hong Kong.

2. Registration
a. You are required to register with us when you use our services or place an order. By registering you are making a statement, upon which we are entitled to rely, that you are aged 18 years or above and capable of forming a legally binding contract.

b. Where you are required to register, you must:
i. provide us with accurate, complete, and updated registration information.
ii. safeguard your username and password; and
iii. authorize us to assume that any person using our site with your username and password is either you or is authorized to act for you.

c. You must inform us immediately of any changes to the information that you provided so that we can communicate with you effectively.

d. In the event that we have reasonable suspicion that any information and material supplied by you to us for registration is untrue, inaccurate, outdated or incomplete and etc., we have absolute discretion to cancel any order made by you and/or terminate/cancel your registration with us and in such circumstances, you hereby agree not to raise any claim against us for whatsoever compensation and reliefs.

3. Order Terms
Our order terms are contained on the Help page under the sections headed Ordering and Shipping and Delivery. All orders are subject to these order terms in addition to these Terms of Use.

4. Use of forwarder
We recommend delivery services for shipping of the products you ordered. Your rights regarding the delivery of the products shall be governed by the terms and conditions of such a forwarder, which will be available for perusal upon request. By choosing the forwarder we recommend, you agree that we will appoint such a forwarder to handle all the aspects of the delivery on your behalf. We will not be responsible for any act or failure to act on the part of such a forwarder. We disclaim any liability whatsoever and you assume all risks and liabilities associated with its use.

a. Delivery service is only available in the region of Hong Kong.

b. In case you choose to use the forwarder that we recommended, and your order reaches a particular Net Order Amount as specified in our FAQ, we will pay the shipping fee to the forwarder on your behalf. Your order will be shipped by the shipping method specified for free.

5. Event of force majeure
A Force Majeure Event shall include any act, event, non-happening, omission, or accident beyond our reasonable control and shall include in particular (without limitation) the following:

If the performance by us under this Website is prevented by reason of force majeure (which shall include fire, casualty, accident, act of God, natural disaster, any law, order, declaration, regulation, demand, or requirement of the Government of Hong Kong or of any of its government agencies, strikes, labor disputes, shortage of labor or lack of skilled labor, shortage or unavailability of products or raw materials, delay in transit Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war or other causes whatsoever beyond the reasonable control of us), we shall not be liable from such performance to the extent of such prevention.

6. Indemnity and Limitation of Liability / Disclaimer
COMOFASHION.COM.HK makes no warranty, statement, or representation, express or implied, with respect to the accuracy, availability, completeness, or usefulness of the information, contained on the Website, and in so far as permitted by law, shall not have any legal liability or responsibility (including negligence) for any loss, damage, or injury (including death) which may result, whether directly or indirectly, from the supply or use of such information.

You agree to indemnify, defend, and hold harmless COMOFASHION.COM.HK from and against all losses, expenses, damages, and costs (including reasonable legal fees) arising from any breach of these Terms of Use or any other activity by you in connection with your use of the site.

You further agree that COMOFASHION.COM.HK shall not be held liable howsoever for your use of the site and you agree to waive all claims that you may have against COMOFASHION.COM.HK for any loss or damages you may sustain in connection with your use of the site. In the event that this disclaimer is unenforceable, the total liability of COMOFASHION.COM.HK , if any, for losses or damages shall not exceed the fees you paid for the particular service or product upon which liability is based.

7. Termination
COMOFASHION.COM.HK may terminate or suspend your access to all or part of the site, without notice, for any conduct that COMOFASHION.COM.HK , in its sole discretion, believes is in violation of any applicable law or is harmful to COMOFASHION.COM.HK or a third party.

8. Modification of Terms
These Terms of Use (including the order terms contained) may be modified from time to time. You should therefore read these Terms of Use and the order terms before you place any order.

9. Governing Law
These Terms of Use (including the order terms contained on the Help page) shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region.

You irrevocably agree that the courts of Hong Kong Special Administrative Region shall have exclusive jurisdiction in relation to any claim or dispute concerning or arising from these Terms of Use and the order terms.
